Terms of Service

1. Acceptance of Terms

By creating an account, using Chuned on any platform (iOS app, web app, or any future surface), or submitting content through our service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Chuned.

These Terms constitute a binding legal agreement between you and Owen Duffy ("Chuned," "we," "us," or "our"), a sole proprietorship based in Seattle, Washington, USA.

2. Description of Service

Chuned is a house music track-identification service. Users submit a YouTube DJ set URL and receive a timestamped tracklist identifying the tracks played, along with links to those tracks on Spotify, SoundCloud, and back to the YouTube video. Chuned also provides:

• Community submissions — users can submit, confirm, and dispute track IDs and full tracklists
• Comments — discussion threads on sets and tracks
• A crowd-sourced correction layer — voting and reputation system for tracklist accuracy

Track identification uses a combination of published-tracklist lookups (via MixesDB and community submissions) and audio fingerprinting (via ACRCloud). We make no guarantee of accuracy. Track IDs are best-effort. Set analysis results may be incomplete, incorrect, or unavailable.

3. Eligibility

You must be at least 13 years old to use Chuned (or 16 years old if you are located in the European Union or another jurisdiction with a higher minimum age requirement). By using Chuned, you represent that you meet the applicable age requirement.

4. Accounts

4.1 Registration

You may use limited features without an account (anonymous session). To access full features, you must register with a valid email address and a username.

4.2 Account Security

You are responsible for keeping your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at legal@chuned.io if you suspect unauthorized access.

4.3 One Account Per Person

You may not create multiple accounts to circumvent usage limits, bans, or any other restrictions.

4.4 Account Deletion

You may delete your account at any time from the Profile screen. See §9 for what happens to your content on deletion.

5. Acceptable Use

You agree not to use Chuned to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of any third party
• Submit content that is defamatory, harassing, threatening, obscene, or otherwise objectionable
• Submit spam, unsolicited commercial messages, or misleading content
• Attempt to reverse-engineer, decompile, or extract the source code of the Chuned app or backend
• Attempt to probe, scan, or test the vulnerability of our systems without authorization
• Circumvent, disable, or otherwise interfere with security-related features of the service
• Use automated means (bots, scrapers) to interact with Chuned's user-facing features without our prior written consent
• Use Chuned for any commercial purpose not explicitly permitted by these Terms
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

6. Your Content

6.1 Content You Own

You retain ownership of content you submit to Chuned — your comments, track ID submissions, and tracklist submissions ("User Content").

6.2 License You Grant Us

By submitting User Content, you grant Chuned a worldwide, royalty-free, non-exclusive, perpetual license to use, store, display, reproduce, modify, and distribute that content in connection with operating and improving the service. This includes displaying your submissions to other users, using them to build our tracklist database, and potentially training or improving identification models.

6.3 Community Submissions Are Public

Track ID submissions, tracklist submissions, votes, and comments are visible to other users. Do not submit content you consider private.

6.4 Accuracy

You agree to submit only track IDs and tracklist data that you believe to be accurate to the best of your knowledge. Deliberately submitting false track IDs to deceive other users may result in account suspension.

6.5 No Copyrighted Content in Comments

Do not paste full copyrighted text (e.g., song lyrics, articles) into comments. Brief quotations for commentary or correction purposes are acceptable.

7. Third-Party Content and YouTube

Chuned analyzes YouTube videos. We do not host, re-upload, or reproduce video or audio content. All playback occurs on YouTube's platform and is subject to YouTube's own Terms of Service (youtube.com/t/terms).

Chuned's use of YouTube API Services is subject to the YouTube Terms of Service. By using Chuned to analyze YouTube content, you agree to comply with YouTube's Terms of Service.

Track identification results (artist names, track titles, timestamps) are factual metadata. Links to Spotify and SoundCloud are provided for your convenience; your use of those platforms is governed by their respective terms.

8. Usage Limits

Chuned enforces the following usage limits to manage costs and ensure fair access. Limits are subject to change.

Exceeding your monthly limit will prevent further analyses until the next billing cycle. Pro subscriptions, pricing, and auto-renewal terms will be disclosed clearly before any payment is required.

9. Content After Account Deletion

When you delete your account:

• Your email address and push token are cleared immediately
• Your Supabase Auth credential is permanently and irreversibly hard-deleted
• Your username is replaced with an anonymous placeholder (e.g., deleted_xxxxxxxx)
• Your track ID submissions, tracklist submissions, comments, and votes remain in the database in anonymized form

This is intentional. Your submissions may be part of shared tracklists or discussion threads that other users rely on. Deleting them would break community-sourced content. If you have a specific request to remove particular submissions, contact us at legal@chuned.io and we will review it on a case-by-case basis.

10. Intellectual Property

The Chuned name, logo, app design, and all original code are owned by Owen Duffy. Nothing in these Terms grants you any right to use the Chuned brand, trademarks, or proprietary code.

Track titles, artist names, and other music metadata returned by Chuned are factual data, not copyrightable by Chuned. Rights in the underlying musical works belong to their respective rights holders.

11. Disclaimer of Warranties

Chuned is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Specifically:

• We do not guarantee that track identification results are accurate, complete, or up to date
• We do not guarantee uninterrupted or error-free access to the service
• We do not guarantee that the service will be available at any particular time or in any particular region
• Beta software may contain bugs, and features may change or be removed without notice

12. Limitation of Liability

To the fullest extent permitted by applicable law, Chuned and Owen Duffy will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to these Terms or the service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $10.

13. Indemnification

You agree to defend, indemnify, and hold harmless Owen Duffy and Chuned from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, your User Content, or your violation of these Terms or any applicable law.

14. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, abused the service, or engaged in behavior that harms other users or the service itself. We will make reasonable efforts to notify you before termination unless the violation is severe. You may appeal a termination by contacting us at legal@chuned.io.

You may stop using Chuned and delete your account at any time.

15. Changes to These Terms

We may update these Terms as the service evolves. We will update the "Last updated" date at the top of this page when we do. Continued use of Chuned after an update constitutes acceptance of the revised Terms. For material changes, we will notify you by email or in-app notification where possible.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of Chuned will be resolved in the state or federal courts located in Seattle, Washington, and you consent to personal jurisdiction in those courts.
